BUDAPEST, June 15 (Xinhua) -- Hungarys' Szeged appeals court dismissed on Thursday the first-instance ruling against a Syrian man named Ahmed H. who involved in clashes between migrants and police at the Roszke border crossing with Serbia on Sept. 16, 2015.
The court in southern Hungary has ordered a retrial, citing inconsistent evidence in the original trial.
Judge Erik Mezolaki said that the first-level court had a legal responsibility to consider all evidence. The evidence and arguments were not made clear, he added.
Prior to the announcement of the sentence, Ahmed H. rejected the charge of terrorist acts. He said that he just planned to help his family get away from war.
The Syrian man was arrested in Hungary in September of 2015 following the clashes. He was accused by state prosecutors of committing acts of terrorism. The prosecutors also claimed that Ahmed H. had thrown rocks at police, and given police an ultimatum. Last November he was convicted by a Szeged court and sentenced to ten years in prison.
The defence appealed for a dismissal of the terrorism charge and a reduced sentence, while the prosecution appealed for a longer prison term.
Hungarian Minister of Foreign Affairs and Trade Peter Szijjarto said on May 29 that the Hungarian government would turn to international organizations over a European Parliament (EP) resolution, which condemns Hungary while exculpating Ahmed H. convicted of attacking Hungary.
According to the minister, the EP resolution on May 17 took stand by Ahmed H., an aggressor threw stones, block of concretes and bottles at the policemen, rather than the Hungarian government.
